A Shaler contractor is accused of not completing a home repair job after a dispute over the color of the windows the homeowner wanted.

Shaler police charged Kevin Gray, 36, owner of KG Contracting, on April 28 with felony counts of deceptive or fraudulent business practices and home improvement fraud.

According to a criminal complaint, a woman told Shaler police on Jan. 13 that she was the victim of fraud.

The woman said she hired Gray to do multiple repairs that included replacing windows, drywall and doors; bathroom remodeling; enclosing a fireplace; and painting, plumbing, concrete work and insulation, the complaint states.

She gave police communications she had with Gray about the agreement and payment for the work that was to be done. She also gave documentation that she had paid him $19,450 between May 28 and Oct. 21.

The woman told police that Gray installed white windows in her home on Dec. 20, when he was supposed to have installed black windows, for which she had paid extra, the complaint states.

Gray acknowledged the error, said he would “make it right” and offered to paint the windows black, the complaint states. The woman declined the offer, saying she wanted black windows installed.

The woman said she asked Gray for receipts for materials he ordered, but he did not provide them, the complaint states. He then stopped communicating with her and most of the agreed upon work was not completed.

When police spoke with Gray, he told them the woman owed him money and the money she had paid was spent on the windows. Gray said the windows he installed could not be returned and he did not have money to buy the black windows, the complaint states.

Gray did not have an attorney listed in court records.

Gray was arraigned April 28 and released on an unsecured $20,000 bail. His preliminary hearing before District Judge Daniel Konieczka Jr. is scheduled for May 7.
