A man released from state prison in Fayette County in late April is accused of stealing a check from a Franklin Park man’s mailbox two weeks later and using it to get $4,100 for himself, according to a criminal complaint.

Franklin Park police filed charges Tuesday, May 19, against Levi Wayne McDermit, 43.

The complaint gives McDermit’s address as 50 Overlook Drive in Luzerne Township, which is the address for the Fayette State Correctional Institution.

McDermit completed a sentence and was released from the prison on April 20, a spokeswoman for the state Department of Corrections said.

According to court records, he pleaded guilty to theft and receiving stolen property in April 2023 in Fayette County. Initially sentenced to probation, McDermit was jailed in September 2023 after not complying with the terms of his probation, according to the District Attorney’s Office.

In court filings, Franklin Park police said a resident came to their station on May 8 to report that a check was stolen from his mailbox and fraudulently cashed out.

According to the complaint, the man told police that on May 4 he wrote a check for $460 for a golf outing and placed it in his mailbox with the flag up. On May 8, he noticed that someone had fraudulently cashed two checks from his account. He had images of the cashed checks from his bank, Citizens.

The check the man had placed in his mailbox was made payable to McDermit for $2,150, the complaint states.

The second check also was made payable to McDermit for $1,950. The check number was still a blank check in the man’s possession, the complaint states.

On May 9, Citizens Bank sent photos of one check being cashed at the Camp Horne Giant Eagle branch and the other at the Kennedy Township branch.

The state identification number used to cash both checks is registered to McDermit, according to the complaint. The identification picture associated with McDermit matches both still photos taken at the bank branches.

Police said McDermit was identified in both pictures by distinct facial features, including facial hair, ears and his long, slender face. He also was wearing the same clothes at both locations, the complaint states.

Franklin Park police charged McDermit with felony counts of receiving stolen property, theft of mail, and access device fraud and misdemeanor counts of receiving stolen property and forgery.

A warrant was issued for McDermit’s arrest.
