EXECUTOR ERRORS: COMMON PROBATE PITFALLS AND HOW TO AVOID THEM You have been named as the Executor in the Last Will and Testament of a loved one. In the days following their passing, you face a myriad of challenges as you manage your own grief, interact with family & friends, and make final arrangements. The most common pitfall we encounter is one that may have significant financial and legal ramifications-waiting too long to open the Estate. Executors and Administrators who wait too long to open the Estate face some additional hurdles preventing an effective Estate Administration. Not only can delayed administration make an Estate ineligible for the Inheritance Tax Discount provided for payments made within ninety (90) days of the date of death, but it can also result in the assessment of interest and penalties if taxes and other outstanding obligations are not addressed in a timely fashion.
