The estate of a woman struck and killed in Oakland last year is suing the driver and his employer.

Brian Maroney’s wife, Jessie Maroney, was killed on Dec. 5 as she crossed the road at Darragh and Terrace streets.

According to the lawsuit, she was near the middle of the intersection around 5:42 a.m. walking to work when she was struck by a delivery truck being driven by Craig Cibrone on behalf of On Time Delivery.

Cibrone was making a lefthand turn onto Darragh Street when he struck Maroney, 37, of South Park.

According to the complaint, he failed to immediately stop and was located by police several hours later.

Maroney died from blunt force trauma.

No charges have been filed against Cibrone, according to Allegheny County court records.

The lawsuit, which names as defendants Cibrone and On Time Delivery, includes claims for negligence and wrongful death.

A message left with the delivery company late Tuesday was not immediately returned.

In January, following Maroney’s death — as well as at least two other fatal pedestrian crashes in that area — city officials made changes to the Terrace Street corridor, including changing the traffic signals, which used to flash overnight.

Instead, they now have red and green 24 hours day. In addition, right turns on red are banned on all four approaches to the intersection.

In addition, pedestrians will have a three-second head start before vehicular traffic can go.
